1 Introduction
By a) enrolling dogs with or b) permitting dogs to attend or c) accepting the Services of the business and its staff, the customer is deemed to have accepted these Terms and Conditions.
2 Membership & Subscription
All services are available exclusively to our customers on a monthly recurring payment model, or otherwise as arranged by separate agreement.
The business operates a fixed monthly fee system for day care and transport, (if chosen), whereby the customer pays a fixed monthly fee for a place at the day care centre for the specified and accepted dog and space on our secure vehicle on agreed regular day/s per week. Monthly membership begins following successfully completing the three trial sessions.
Fees are calculated based on the average number of weeks per calendar month, i.e. each invoice is for 4.33 weeks. Therefore, if the customer does not send their dog for any reason, for example due to holiday or sickness, the monthly fee for the agreed regular days and dog transport if applicable is still payable in full. Requests can be made for make-up days for holidays taken. We request that standing order payments to be set up to go out on the first of each month.
3 Attendance
Clients signing up to the business for 1 or more days per week may swap their agreed regular service day(s) on an ad hoc basis subject to availability providing advance notice of non-attendance has been given. Cancellations of booked services must be made before 12pm the previous working day otherwise they will not be banked and will still be charged. For all clients, banked days must be used within 2 months, are non-refundable and cannot be exchanged for cash on leaving or if left banked beyond the 2-month swap period. It may be possible to add occasional extra, ad hoc days as required, subject to availability. (A banked day is a paid day that’s cancelled in time and saved to be used later)
Dogs must be dropped off and collected during agreed hours. Late collection may incur additional charges.
If a dog is not collected on time and we cannot reach the owner or emergency contact, we may contact a local boarding facility or animal authority. Any costs incurred will be charged to the owner.
4 Fees and Payment
Fees are payable monthly in advance by bank transfer/standing order, to be arranged by the customer. Payments must be set to leave the customer’s account on the 1st day of each calendar month. Other agreed payment methods may be accepted. Like many businesses, we review our fees each year in line with inflation and rising costs. This helps ensure we can continue offering reliable, high-quality care. The business reserves the right to amend prices with at least 30 days’ written notice. Payment for additional sessions must be made a minimum of 48 hours before a session.
5 Renewal and Cancellation
Memberships renew automatically each month.
You may cancel your subscription by giving 14 days’ notice in writing before your next billing date.
No refunds are issued for partial months.
6 Dog Eligibility & Health
Owners must advise of any illness prior to us collecting or them dropping off their dog – we request that you are particularly vigilant for any signs of your dog coughing or of stomach upsets/diarrhoea.
Any animal with a contagious illness cannot be accepted and should this illness develop while they are attending, we will contact you to collect them. We will treat all minor injuries and report back to you. In the event of a serious injury your vet will be called and you will be informed using the emergency contact number supplied.
All vet bills incurred from treating your animal are your responsibility regardless of how the injury was sustained.
An application form must be completed together with the customer declaration form prior to any dog attending. As part of the client/subscriber responsibilities you are obliged to keep all medication, illness, allergies and vaccination records be kept up to date and informed us if anything has changed from previously stated by the customer.
Each dog has to complete 3 trial sessions to check they will settle into day care. The owner does not need to stay for the trial sessions.
The first 2-hour trial session is free with the following 2 full day trial sessions charged at the normal daily rate.
No dog registered under the Dangerous Dogs Act 1991 or Dog hybrids registered under the Dangerous Wild Animal Act 1976 (e.g. Wolf Hybrids) and dogs subject to Dog Control Notices under the Control of Dogs (Scotland) Act 2010 are allowed to be accepted as per license conditions.
All dogs male and female must be neutered (over the age of six months) and friendly. Any dogs found to be aggressive will not be accommodated.
7. Vaccinations and Health Requirements
In addition to the standard annual vaccinations, we also ask that you obtain the kennel cough vaccination, tick, flea and worm treatments for your dog prior to attending Day Care. These vaccinations and treatments must be kept up to date and copies of certificates produced at the time of making an application and after each annual vaccination.
8. Behaviour and Temperament
Dogs must be socialised and non-aggressive. The business reserves the right to deny entry or terminate membership for any dog that does not settle in the environment or that poses a safety risk.
The business reserves the right to have any dog removed from their current day care participation or any future day care participation if the dog becomes unsociable or aggressive and the owner could be asked to remove their dog from the premises with immediate effect. If this situation arises there would be no refund for any unused time paid or contracted.
9. Medical Conditions
Owners must disclose all known health conditions. The business will not be held responsible for any consequences of undisclosed medical issues.
10. Owner’s Risk
While every reasonable effort is made to ensure the safety and wellbeing of all dogs in our care, owners are strongly encouraged to have their own pet insurance to cover any illness, injury, or unforeseen incidents that may occur while their dog is attending daycare. Dogs are left in our care at the owner’s risk
11. Emergencies & Veterinary Care
In the event of illness or injury, we will attempt to contact you immediately. If necessary, we will seek veterinary attention at your expense.
12. Liability, Risk & Responsibility
While every effort is made to ensure the safety of all dogs, the business cannot accept liability for:
Injury, illness, death, or loss not caused by proven negligence
Damage to personal items or belongings
13. Photos & Social Media
With your permission, we may photograph or film your dog for use on our website and social media platforms. You may withdraw consent at any time in writing.
14. Legal Jurisdiction
These Terms and Conditions are construed under the laws of Scotland and by the Courts of Scotland
15. Complaints Procedure
At Torr Farm Dog Day Care, Station Road, Rhu, G84 8LP, we take all concerns seriously. If you have a complaint, please raise it directly with the business owner, Anne Ferguson, either in person, by phone, or in writing. We aim to acknowledge all complaints within 3 working days and resolve them as quickly and fairly as possible.
16. Amendment of Terms and Conditions
The Business reserves the right to amend these Terms & Conditions, or introduce new ones, at its discretion. All subscribers will be given 14 days’ notice prior to any changes taking effect, along with the effective date of the updated Terms & Conditions.
17. Licenses and Insurance
The Business holds a valid Commercial Day Boarding Licence issued by Argyll and Bute Council and is fully insured to operate as a dog daycare provider. Staff members are qualified in Level 3 Pet First Aid and bring with them extensive experience in caring for dogs and other livestock animals, ensuring a safe and knowledgeable environment for all animals in our care.
